Paid Events – Terms, Disclaimer & Liability

This document governs your use of paid events on InsigniaStats.live. You must accept these terms (e.g. by checkbox) before registering for a paid event or adding a Bitcoin wallet. A link to this document will appear on the Paid Events subpage and in the event creation flow for organizers.
1. No Affiliation with Insignia
Paid events hosted or listed on InsigniaStats.live are not operated by, endorsed by, or affiliated with Insignia (the Xbox network emulation project) or its official services. InsigniaStats.live is an independent statistics and community site operated by Tiny Umbrella, LLC. Any paid events, Bitcoin payments, prizes, or promotions are solely the responsibility of the event organizers and/or Tiny Umbrella, LLC, and are in no way part of Insignia's services or responsibilities.
2. Eligibility and Geographic Compliance
- You must be at least 18 years of age to participate in paid events. In Wyoming and any other jurisdiction where the law requires a higher minimum age (e.g. 21), you must meet that age requirement.
- You are responsible for determining whether participation is legal in your jurisdiction (including any gambling, gaming, or payment regulations). Tiny Umbrella, LLC and InsigniaStats.live are not responsible for your compliance with local, state, or national laws. By participating, you represent that you are permitted to do so under applicable law.
- We may restrict or block access from certain regions where paid events are not permitted; such restrictions do not create any obligation on our part to monitor or enforce laws in your location.
3. Skill-Based Events; No Gambling
Paid events on InsigniaStats.live are skill-based (e.g. racing, competitive gameplay such as Halo 2). Where required by applicable law, these events are offered for entertainment purposes and do not constitute gambling. In jurisdictions that restrict or prohibit certain prize or gaming terminology, we may use alternative wording as required by law. Participation is at your own risk and subject to these terms.
4. Bitcoin and Value Risks
- Volatility: The value of Bitcoin (BTC) and satoshis fluctuates. The monetary value of any prize, entry fee, or pot may increase or decrease between the time you pay, the time the event runs, and the time payouts are made. InsigniaStats.live and event organizers do not guarantee any specific fiat (e.g. USD) value.
- Fees: Sending and receiving Bitcoin may involve network and/or third-party fees (miner fees, exchange fees, wallet fees). These fees are the responsibility of the user. Prize amounts and payouts are typically quoted in satoshis; actual amount received may be reduced by fees.
- Irreversibility: Bitcoin transactions are generally irreversible. Payments sent to the wrong address or in error cannot be recovered by InsigniaStats.live.
5. Payout Timing
- Target: We aim to process payouts to winners within five (5) business days after event results are finalized and the payout is approved. Actual timing may vary and is dependent on the event organizer as well as Tiny Umbrella, LLC. Both the event organizer and an administrator must approve payouts where applicable.
- No guarantee: Payouts are processed manually or semi-automatically; we do not guarantee a specific payout date except as required by law. Delays may occur due to verification, technical issues, or force majeure.
6. Refunds and Cancellations
- Refunds of entry fees will be considered only if the event is cancelled. Refunds are not guaranteed for any other reason (e.g. no-shows, disqualification).
- Refunds, when issued, will be in Bitcoin (or satoshis) after deduction of any applicable fees (e.g. network fees already incurred). The amount refunded may be less than the amount originally paid.
- Whether a refund is issued may be decided by either the event organizer or Tiny Umbrella, LLC, depending on the circumstances.
7. Taxes
- Winners are responsible for reporting and paying any taxes (income, withholding, or otherwise) in their jurisdiction. Tiny Umbrella, LLC does not withhold taxes unless required by law (e.g. for prizes exceeding the threshold set by applicable law, such as $10,000 or other legally mandated amount).
- If tax forms (e.g. W-9 in the United States) are required by law for a payout, we may collect them before releasing the payout. You agree to provide accurate information when requested.
8. Disputes and Appeals
- Appeals: If you believe you were not paid correctly or that the wrong winner was selected, contact info@insigniastats.live with your event details, username, and a description of the issue. We will review in good faith but are not obligated to reverse any decision.
- Reporting deadline: You must report a missing or incorrect payout within seven (7) days after the payout was due or the results were published. Reports received after that period may not be considered.
- Arbitration; no class actions: To the extent permitted by law, any dispute arising from these terms or paid events shall be resolved by binding individual arbitration in accordance with the rules of a recognized arbitration provider in Wyoming. You waive any right to participate in a class action or class-wide arbitration. This clause is intended to reduce litigation cost and liability while preserving your ability to pursue individual claims.
9. Sponsor and Organizer Liability
- Sponsors: If an event has a sponsor, the sponsor is solely responsible for its own promises and obligations. Tiny Umbrella, LLC and InsigniaStats.live are not responsible for sponsor conduct, sponsor-funded prizes beyond our role as platform, or any sponsor terms. Any "Sponsored by" or similar designation is for information only.
- Organizers: Event organizers who create or manage paid events must agree to separate Paid Events Organizer Terms before creating such events. Organizers are responsible for their events' rules, winner selection, and compliance with these terms.
10. Prohibited Conduct
- You may not: (a) initiate chargebacks or reverse payments in bad faith; (b) use "anonymous" contributions or other features to launder funds or evade law; (c) use multiple accounts to cheat or gain unfair advantage in events; (d) collude with others to manipulate results; (e) provide false information (e.g. wallet, identity); or (f) otherwise abuse the paid events feature or other users.
- Consequences: Violation may result in ban from paid events, forfeiture of any payout, and/or suspension or termination of your account. We may report suspected illegal activity to authorities.
11. Disclaimer of Warranties and Limitation of Liability
- "As is": The paid events feature and any related services are provided "as is" and "as available" without warranties of any kind, express or implied. Tiny Umbrella, LLC and InsigniaStats.live disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- No liability for losses: To the fullest extent permitted by applicable law, Tiny Umbrella, LLC and InsigniaStats.live shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to participation in paid events, use or inability to use the feature, Bitcoin volatility or fees or failed/delayed transactions, actions of organizers/sponsors/users, unauthorized access to data, or any other matter relating to the service.
- Cap: In no event shall total liability exceed the amount you actually paid to participate in the specific event in question (converted to USD at a reasonable rate at the time of payment), or one hundred U.S. dollars (USD 100), whichever is less, to the extent permitted by law.
12. Force Majeure
Tiny Umbrella, LLC and InsigniaStats.live shall not be liable for any failure or delay in performing obligations (including payouts) due to circumstances beyond reasonable control, including but not limited to: natural disaster, war, terrorism, pandemic, government action, critical infrastructure or power failure, Bitcoin or blockchain network failure or congestion, or other force majeure events. Affected obligations may be suspended for the duration of the event; we will use reasonable efforts to resume performance.
13. Privacy and Data
Data collected in connection with paid events (e.g. wallet address, username, amounts, transaction IDs, scores, time played, and other event-related data) is processed in accordance with our Privacy Policy (see Privacy Policy or the link in the site footer). By participating, you agree to that policy.
14. Acceptance and Changes
- Acceptance: By checking the box or otherwise accepting these terms before registering for a paid event or adding a wallet, you acknowledge that you have read, understood, and agree to these terms.
- Changes: We may update this document from time to time. Continued use of paid events after changes constitutes acceptance of the updated terms. Material changes may be communicated via the site or to your email if we have it. If you do not agree, you must stop participating in paid events.
15. Governing Law and Severability
- These terms shall be governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any arbitration or legal action shall be in Wyoming, to the extent permitted by law.
- If any provision is held invalid or unenforceable, the remaining provisions shall remain in effect.
Summary: Paid events are not part of Insignia. Operated by Tiny Umbrella, LLC (Wyoming). You must be 18+ (21+ in Wyoming or your jurisdiction if required). Skill-based; you are responsible for your jurisdiction's laws. Bitcoin value and fees can affect prizes. We aim for payouts within 5 business days (dependent on organizer); both organizer and admin approve. Refunds only if event cancelled, after fees. Winners responsible for taxes unless law requires otherwise. Report payout issues within 7 days to info@insigniastats.live. Disputes by individual arbitration; no class actions. Sponsors and organizers are responsible for their own obligations. Prohibited conduct may result in ban or forfeit. No warranties; liability limited. Force majeure applies. You accept by checkbox before registering or adding a wallet.
